Capfluence Inc. ("Capfluence," "we," "us," or "our") is committed to protecting the privacy of individuals who visit our website at www.capfluence.app and use our prospecting platform (collectively, the "Platform"). This Privacy Policy describes how we collect, use, disclose, and protect your personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act ("PIPEDA") and applicable provincial privacy legislation.
Capfluence is a corporation registered in Canada and operating in the Province of Ontario. By accessing or using the Platform, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.
2. Information We Collect
2.1 Information You Provide to Us
When you create an account or use the Platform, we collect information that you voluntarily provide, including: your full name; email address; phone number; company name; date of birth; professional experience and education history; and payment information (processed securely through Stripe).
2.2 Information Collected Automatically
When you use the Platform, we automatically collect certain information, including: usage data tied to your user ID (not your name), such as features accessed, queries made, and data exported; device information, including browser type, operating system, and IP address; and cookies and similar technologies used for platform stability and functionality.
2.3 Third-Party Data (Prospect Data)
Our Platform aggregates data about businesses and individuals ("Prospect Data") from various sources, including licensed private data vendors, publicly available sources, and our proprietary web crawlers. This Prospect Data may include names, email addresses, phone numbers, job titles, company information, and other professional details. This data is collected and processed under data sharing agreements with our vendors and in compliance with applicable laws.
3. How We Use Your Information
We use the personal information we collect for the following purposes: to provide, operate, and maintain the Platform; to process your subscription and payments; to verify your identity and email address; to communicate with you about your account, updates, and support inquiries; to monitor and analyze usage patterns to improve the Platform; to ensure the security and stability of the Platform; to comply with legal obligations; and to enforce our Terms and Conditions.
4. How We Share Your Information
We do not sell your personal information. We may share your information in the following circumstances:
4.1 Service Providers
We share information with third-party service providers who perform services on our behalf, including: Stripe, for payment processing (Stripe's privacy policy governs their use of your payment information); and Amazon Web Services (AWS), for data storage and computing infrastructure.
4.2 Legal Requirements
We may disclose your information if required to do so by law or in response to valid legal requests, such as court orders, subpoenas, or government investigations.
4.3 Business Transfers
In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.

We may share your information with third parties when you have provided your explicit consent to do so.
5. Cookies and Tracking Technologies
We use cookies and similar technologies to maintain the stability and functionality of our Platform. These are essential cookies required for the Platform to operate properly. We do not use cookies for advertising or analytics tracking purposes. 6. Data Storage and Security
Your information is stored and processed using Amazon Web Services (AWS) infrastructure. We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption, access controls, and regular security assessments. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
7. Data Breach Notification
In the event of a data breach involving your personal information that creates a real risk of significant harm, Capfluence will notify you and the Office of the Privacy Commissioner of Canada in accordance with the requirements of PIPEDA. Notification will be provided as soon as feasible after the breach is discovered and will include information about the nature of the breach, the personal information involved, and steps you can take to protect yourself. We maintain incident response procedures to ensure prompt and appropriate handling of any security incidents.
8. Data Retention
We retain your personal information for as long as your account is active and as needed to provide you with the Platform. Following the termination or cancellation of your account, we will retain your account data for one hundred twenty (120) days, after which it will be permanently deleted from our systems. We may retain certain information for longer periods as required by law or for legitimate business purposes, such as resolving disputes or enforcing our agreements.
9. Your Privacy Rights (Platform Users)
Under PIPEDA and applicable provincial privacy laws, you have the following rights regarding your personal information:
9.1 Access
You have the right to request access to the personal information we hold about you.
9.2 Correction
You have the right to request that we correct any inaccurate or incomplete personal information.
9.3 Withdrawal of Consent
You may withdraw your consent to our collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions. Please note that withdrawing consent may affect your ability to use the Platform.
9.4 Deletion
You may request the deletion of your personal information, subject to our retention obligations and legitimate business needs.

10. Rights of Individuals in Our Prospect Database
If your personal information appears in our Prospect Data database (i.e., you are not a user of the Platform but your contact information is available to our users), you have rights under PIPEDA and applicable privacy laws. You may:
10.1 Request Access
You may request to know what personal information we hold about you in our database.
10.2 Request Correction
You may request that we correct any inaccurate information about you.
10.3 Request Removal (Opt-Out)
You may request that your personal information be removed from our Prospect Data database. Upon receiving and verifying your request, we will remove your information from our active database within a reasonable timeframe.
To exercise any of these rights, please send an email to support@capfluence.app with the subject line "Prospect Data Request" and include your full name, email address, and a description of your request. We will respond to your request within thirty (30) days. Please note that we may need to verify your identity before processing your request.
11. Third-Party Data and User Responsibilities
The Prospect Data available through our Platform is aggregated from licensed data vendors, public sources, and proprietary web crawlers. While we take reasonable steps to ensure the accuracy and lawful collection of this data, users of the Platform are solely responsible for their use of Prospect Data, including compliance with Canada's Anti-Spam Legislation (CASL) and all other applicable privacy and data protection laws. We are not responsible for how users utilize the data obtained through the Platform.
12. Children's Privacy
The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will take steps to delete such information promptly.
13. International Data Transfers
Your information may be stored and processed in Canada or in other countries where our service providers maintain facilities. By using the Platform, you consent to the transfer of your information to countries outside of your country of residence, which may have different data protection rules. We take appropriate measures to ensure that your personal information remains protected in accordance with this Privacy Policy and applicable law.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by posting the updated Privacy Policy on the Platform and updating the "Effective Date" at the top.
